Terms of service

These terms cover CreativeDeals.com and OwnerFinanceProperty.com. Both sites use one account system and one listings database. CreativeDeals runs them. If you create an account, publish a listing, or pay a fee, you agree to these terms.

What the sites are

The sites are advertising venues. People post listings for homes, land, commercial property, businesses, and notes, and other people read them and send a message. CreativeDeals is not a party to any purchase, note, lease, option, wrap, or assumption. A listing is the poster’s advertisement, not ours.

What we do not do

CreativeDeals is not a real-estate broker, business broker, mortgage lender, loan originator, loan servicer, or escrow agent. We do not negotiate price or terms. We do not choose a buyer or a seller for you. We do not hold, transmit, or escrow purchase money, down payments, rent, or note payments. We do not charge a success fee, a commission, or a fee that depends on a closing. We do not pay or charge a fee per referral or per introduction.

Joint ventures, syndicates, and fractional interests are not offered and may not be listed. Nothing on the sites is an offer to sell a security.

Who can use the sites

You must be 18 or older to create an account or publish a listing. You are responsible for your own licenses. Someone who seller-finances more than one property, or who arranges financing for other people for pay, may need a mortgage or broker license. The sites do not decide that for you.

Accounts

Sign-in uses an email link. You are responsible for the mailbox you give us. You can ask us to delete the account. The privacy policy explains how.

Listings and messages

Listings have to follow the listing policy: no phone number, email, or link in the description, no duplicate of the same deal at the same address, and a confirmation that you have the right to use the photos. We can refuse a listing, send it back with a note, or remove it. If we ask for a fix, you have 48 hours to update it and send it back for review.

Messages are between users. Do not ask CreativeDeals to negotiate for you. Do not send money through a message.

Fees

Browsing is free. Paid products, when billing is turned on, are flat fees only: a Pro or Broker subscription, a 30-day featured listing, and a directory ad. The current amounts are on the Pricing page. Paying a fee buys the software or the advertisement described there. It does not buy a buyer, a closed deal, a lead guarantee, or an endorsement.

Canceling a subscription

Pro, Broker, and monthly directory ads renew until you cancel. Cancel from Manage billing on your account page, or email hello@creativedeals.com from the address on the account. Cancellation stops the next renewal. You keep the paid period you already bought. We do not refund the current period, except where the law requires a refund. If a charge was a clear billing error, email us and we will correct it.

30-day featured listings

A featured listing is a one-time flat fee for 30 days at the top of search. If you ask us to cancel before the feature starts, we refund the fee. After the feature has started, the fee is not refunded, because the placement has already run. If we take the listing down because it broke the listing policy, the fee is not refunded. If we cannot run the placement because of our own error, we refund the fee.

Calculators and directory ads

Calculators are estimates from the numbers you type. They are not a lender’s schedule and not a promise of a payment. A directory ad is a flat-fee advertisement. It is not an endorsement, not a referral, and not proof that the person is licensed. Check licenses yourself.

Your content

You keep ownership of what you post. You give CreativeDeals permission to display it on both sites, in search, and in alerts, for as long as the listing or ad is on the service. You confirm you have the right to post the text and the photos. Do not post someone else’s private information.

Sample material

Some listings and directory cards are fiction and are labeled sample. Do not rely on them. Do not treat a sample person as a real professional.

Disclaimers

The sites are provided as they are. We do not promise that a listing is accurate, that a buyer or seller will perform, or that a deal will close. Read the disclosures page. Have your own licensed attorney, and a tax adviser when money or a business is involved, read the papers before anyone signs or sends money.

Governing law

These terms do not name a state. CreativeDeals may update this page to name the state whose law applies and the courts that hear a dispute. Until that update is posted here, with a new “Last updated” date, neither side is agreeing to a particular state’s courts just by using the sites. A consumer-protection law that says a right cannot be waived still applies.

Changes

We can update these terms by posting a new version on this page. The date at the top is the date of the current version. If you keep using the sites after that date, the new version applies to new listings and new fees. A fee you already paid keeps the refund rules that were posted when you paid it.
